Terms and Conditions

1. These terms and conditions, as published on the website www.mswalottery.com.au and as amended from time to time (“Terms”), govern the terms of participation in the MSWA Mega Home Lottery (“Lottery”) operated by MSWA LIMITED (ABN 75 638 080 972) (“MSWA”).Where it is lawful to do so, these Terms may be updated and re-published online at www.mswalottery.com.au. It is up to the participant to review the Terms prior to entering the Lottery. MSWA does not warrant that the Terms remain unchanged between lotteries. These Terms were last reviewed and updated on 2 December 2025.

2.    MSWA reserves the right to vary, suspend, or cancel the Lottery at any time, subject to obtaining all necessary regulatory approvals. If this occurs, MSWA will take all reasonable steps to notify participants via the official website and other appropriate communication channels. In the event of suspension, MSWA will immediately cease ticket sales noting all tickets purchased prior to suspension remain valid pending regulatory directions. If the Lottery resumes, MSWA will provide notice of a new draw date and any variations to these Terms. In the event of cancellation prior to the Lottery being drawn, MSWA will facilitate full ticket refunds for any eligible tickets in accordance with regulatory directions.

3.    In Western Australia, lotteries are regulated by the Gaming and Wagering transfer Commission of Western Australia’s Department of Local Government, Industry Regulation and Safety (“Gaming and Wagering Commission”).
 

Entry and Participants 
4.    By purchasing a ticket in the Lottery, participants will be deemed to have read and agree to be bound by these Terms.

5.    The following people and all who reside at their same residential address are prohibited from entering the Lottery: 
a.    MSWA Board Members; 
b.    MSWA Executive Team Members;
c.    MSWA Head of Departments;
d.    MSWA Marketing Team Members;
e.    MSWA Information Systems Team and Ticket Fulfilment Staff;
f.    BDO Australia Directors and employees associated with the lottery draw; and
g.    Any staff member who works on the MSWA Account from MSWA’s associated agencies (individually and together, “MSWA Affiliated Person”).
h.    Any staff member whose regular workspace or assigned duties are in close physical proximity to the Lotteries Team or any team responsible for processing, fulfilling or managing lottery operations. This includes, for examples, employees in shared office area adjacent to the call centre or fulfilment areas.”

6.    Participants must not be under the age of 18 years (“Underage Participant”).

7.    Participants must not be residing outside of Australia at the time of purchasing any ticket, unless they are able to provide proof of an Australian address and/or Australian bank account. (“Internationally Based Participant”). 

8.    Due to legislation surrounding foreign investment including in respect to the transfer of land, participants must be Australian permanent residents or Australian citizens.  As such, participants must not be classified as a “foreign person” as defined in section 4 of the Foreign Acquisitions and Takeovers Act 1975 (Cth) (“Foreign Resident”).

 

Participant’s Information 
9.    Name changes on tickets are not permitted, and therefore the onus is on the participant to ensure that they provide the correct information to MSWA upon the purchase of each ticket.

10.    All participants must ensure their postal address is up to date when purchasing a ticket as address changes may not be possible or accommodated following the prize draws.

11.    The records held by MSWA, as provided by the participant, shall be deemed as correct and final.
 

Tickets
12.    MSWA reserves the right to refuse sale or refund tickets to an individual at their discretion.  The participant acknowledges and agrees that MSWA is not required to provide reasons for the exercise of its discretion to not refund a ticket.

13.    Lottery ticket prices are set at $100 Australian Dollars per ticket.

14.    A maximum of 206,250 tickets are available for sale.

15.    If all 206,250 tickets are sold, each ticket will have a 1 in 19 chance of winning a prize.

16.    MSWA is not authorised to process ticket refunds without written approval from the Department of Local Government, Industry Regulation and Safety (WA). This regulatory approval process may take a number of weeks to complete.

17.    No refunds can be requested or offered once the next scheduled draw process within the lottery has commenced. Any refunds validly requested and approved by the regulator will only be processed and paid following the completion of the next draw within the lottery.


Prize Draw Process
18.    MSWA’s auditors, BDO Australia, will attend all prize draws to ensure completeness and fairness of the draws

19.    The winners will be determined by a computerised random number generator which has been approved by the Gaming and Wagering Commission. Each ticket purchased in time has the same probability of winning any eligible prize.

20.    If any MSWA Affiliated Person, Underage Participant, Internationally Based Participant, or Foreign Person enters the Lottery contrary to these Terms and wins a prize, they will be ineligible to receive that prize or any benefit from that prize (“Ineligible Prizes”).  

21.    There will be a redraw for those Ineligible Prizes by MSWA as soon as practicable in the same manner as the original draw occurred as described in these Terms, at a time and manner as approved by the Gaming and Wagering Commission (“Redraw”). If the Grand Prize becomes an Ineligible Prize, then all of the draws that have already occurred are deemed correct and final. Only the Grand Prize and other Ineligible Prizes will be subject to the Redraw. 


Prizes
22.    The total combined retail value of all of the prizes is AUD $7,321,548 as at the time of MSWA’s purchase of said quote.

23.    There are three categories of prizes (particularised further in the Prize Specifics section of these Terms below), being the:
a.    Early Bird Prize: where the Early Bird prize is a Nedlands apartment valued at AUD $1.75 million located in The Gardens Apartment. There is only one Early Bird Prize.
b.    Grand Prize: where the Grand prize is a house valued at AUD $4 million located in South Perth, WA as well as AUD $100,000 in cash.
c.    Total Prize Pool: The total prize pool includes entertainment, holiday, and voucher prizes as itemised under Prize Specifics [Clauses 53 to 68]. There are 10,940 prizes in total. Prize values are based on the recommended retail price at the time of printing; the Promoter accepts no responsibility for any change in prize value between now and the ultimate prize redemption date.

24.    Each ticket purchased before the relevant sales close date referred to in the Key Dates section above will allow the participant a chance to win a prize in each of the prize categories.

25.    In order to be eligible to win a relevant prize, a participant must purchase their ticket before the sales close date of that particular prize.  

26.    If a participant wins a cash prize and winner resides in the state of Victoria, the cash prize will be substituted with gold bullion of equivalent value, in accordance with Victoria Regulation Act 2003 and Gambling Regulations 2015 enforced by the Victorian Gambling and Casino Control Commission (VGCCC).

27.    All prize winners will be notified in writing by way of email or posted by way of registered post to the prize winner’s postal address within 5 days of winning.

28.    To claim prizes, ticket purchasers agree to provide to MSWA, upon request, proof of:
a.    identity, including a 100-point identification check; 
b.    an Australian address; and / or
c.    an Australian bank account (where the prize is cash or cash equivalent).

29.    Prizes are awarded as per the name on the ticket.

30.    Promotional images of the prizes are for display purposes only. Prizes awarded may not be exactly as illustrated.

31.    MSWA conducts its own reasonable due diligence on all properties awarded as prizes, including by getting building and pest report(s) conducted on relevant buildings.  Outside of ensuring that it takes reasonable steps prior to purchasing any properties awarded as prizes, MSWA makes no warrant as to the condition of the property.  MSWA takes no responsibility for any repairs or rectification of any structure or chattel that may be required.

32.    Participants agree that where there is a manufacturer or other issue in respect of a Final Prize, prize winners must first contact the relevant supplier in respect of manufacturer or other warranties before contacting MSWA.

 

Prize Draw Dates
33.    There are three prize draw dates referred to in the Key Dates section of these Terms above.

34.    Notwithstanding the dates set out in the Key Dates section above, the relevant prize draws may be conducted earlier if all of the tickets have been sold.  If all of the tickets are sold before a relevant sales close date, then the remaining draws will all occur on the next scheduled draw date.
 

Publicity and privacy policy
35.    By entering the Lottery, the participants who win any prizes agree to have their name and suburb published by MSWA for publicity purposes.

36.    Prize winners consent to videos, audio recordings, and photographs of them being used for reasonable promotional activities both in print, and on the internet including on social media platforms.

37.    Participants acknowledge and agree that the names of all Early Bird Prize, Mega Cash Prize, and Grand Prize winners will be published on MSWA’s website within 48 hours of the relevant prize draw.  

38.    Participants acknowledge and agree that a complete list of all winners, including Final Prize winners, will be published within 48 hours after all remaining prize draws have been completed.  

39.    MSWA will not disclose any confidential or personal information to any person other than in accordance with these Terms and the MSWA privacy policy (“Privacy Policy”).  Where there is an inconsistency between these Terms and the Privacy Policy, participants agree that these Terms take priority.  For information on the Privacy Policy, visit mswalottery.com.au/privacy-policy or for a printed copy, call 1300 769 019.

40.    By purchasing a ticket, participants agree to receive promotional materials for and/or from MSWA and its related entities. 
 

Limit of liability
41.    MSWA and associated agencies accept no responsibility for any loss, damage, accident, death or injury resulting from the Lottery, or the use or misuse of any prize that may be won within the Lottery.

42.    The participants agree that they will use any prize they may receive reasonably, and in accordance with the relevant manufacturer’s applicable recommendations.

43.    All participants agree to release and indemnify MSWA against any claim they may have in respect of all liability, cost, loss, damage, or expense arising out of acceptance of any prize or participation in the competition including (but not limited to) loss of income, personal injury, and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise

44.    In the event of a dispute, participants should first contact MSWA by emailing [email protected] or calling 1300 769 019. The MSWA Call Centre and/or Sales and Service Team will attempt to resolve the matter. If resolution cannot be achieved, the issue will be escalated to the Call Centre Team Leader, who may request the participant to submit the details in writing. From this point, the matter will be referred to MSWA Lotteries Management, who will work with the participant to reach a fair and reasonable resolution..
  

Delivery of Prizes
45.    Winners are ultimately responsible for claiming their prize, therefore participants are required to ensure that their postal address is up to date in the event that they are to win a prize and their prize is to be posted.

46.    The Lottery is run primarily within, but is not exclusive to, Western Australia. Prize winners may be required to provide an address in the Perth metropolitan area for local delivery, make alternative arrangements to collect the prize(s), or communicate directly with the supplier of the prize(s).

47.    MSWA will not be liable for any additional shipping or postage costs that may be incurred in respect of relocating any prize outside of Western Australia.

48.    The participant agrees to collect any prizes from a reasonable location around Western Australia at the reasonable direction of MSWA.

49.    MSWA makes no warranty that any vehicle(s) will be readily and immediately available within Western Australia. Participants acknowledge that there may be delays in the physical arrival of the car and/or caravan into Western Australia due to manufacture, international shipping, and logistical constraints.  MSWA will enter into a contract for the sale of the vehicle with a third-party supplier and arrange for the vehicle’s delivery within Western Australia (“Vehicle Contract”). The Vehicle Contract will demonstrate that the prize winner is entitled to receive the vehicle. MSWA will deliver the Vehicle Contract to the prize winner within 30 days of the end of the Lottery. 
 

Donation of Unwanted Prizes
50.    MSWA is a non-profit organisation (registered with the Australian Charities and Not-for-profits Commission) that provides vital support and services to people living with neurological conditions in Western Australia. MSWA accepts donations for the support of MSWA’s purpose and activities.

51.    In the event that a prize winner no longer wishes to receive a prize, that prize winner may donate the prize to MSWA by expressly informing MSWA of this intention at any point in time, including prior to delivery. 
 

Property Specifics

52. Real Property Prizes (Homes and Apartments)
a.    The winner must take the property won subject to the encumbrances that apply to it. The winner may also be required to execute other documents relating to the property. If applicable, the property cannot be transferred to the winner until this documentation is completed. For example, it may be that MSWA, when it purchased the relevant property, was required by the seller to agree certain terms and conditions and these terms and conditions were intended to continue to apply to any new owner, mortgagee or other encumbrance holder of that property. This is often the case with new strata titled developments, but can also apply to other properties. 
b.    If required, the winner must accept the relevant terms and conditions in the sale contract that applied to MSWA, to the extent they were intended to apply to any future owner of the property. The winner may be required to sign a document, likely a deed of covenant, agreeing to be bound to the relevant terms and conditions and which may include charge, granting the original seller or developer the right to lodge a caveat on the property and restrictions on all owners of the property from encumbering the property without first reverting to original seller or developer. 

 

Prize Specifics

53. Grand Prize:
a.    The Grand Prize winner valued at AUD $4 million will win the South Perth Home fully furnished. The Grand Prize home is located at 42 Angelo Street, South Perth WA 6151.
b.    In addition, the winner will receive an AUD $100,000 bank deposit or bank cheque made out to the ticket holder(s).
c.    To claim the prize, the winner will be required to complete a 100-point identification check and present their official winning ticket.
d.    The AUD $100,000 bank deposit or bank cheque will be received within a maximum of 20 business days after the 100-point identification check has been completed and verified.
e.    All tickets purchased before 11:59 PM (AWST) Thursday, 15 October 2026 are eligible to win the Grand Prize.
f.    The published estimated value of the Grand Prize is calculated based on the valuation of the home, stamp duty, furnishings, appliances, landscaping, artwork and any custom upgrades made to the property or building, and may not be accurate.
g.    MSWA’s settlement agents will undertake the conveyancing on behalf of MSWA and all settlements/conveyancing/transfer costs will be paid by MSWA.
h.    Every endeavour will be made to transfer the Grand Prize Home to the winner as soon as possible. The conveyancing process is dependent on information supplied by a number of government departments and public utilities. Settlement is generally completed within 3 months of the Grand Prize winner's 100-point ID check being completed and verified.
i.    Prize must be accepted, as awarded, with no cash equivalents available. 


 

54. Early Bird Prize
a.    The Early Bird Prize winner valued at AUD $1.75 million will win the Gardens Apartment fully furnished. The Early Bird Prize home is located at Apartment G05/17-19 Louise Street, Nedlands WA 6151.
b.    To claim the prize, the winner will be required to complete a 100-point identification check and present their official winning ticket.
c.    Only tickets purchased before 11:59 PM (AWST) Thursday, 10 September 2026 are eligible to win the Early Bird Prize.
d.    The published estimated value of the Early Bird Prize is calculated based on the cost to MSWA for the apartment, stamp duty, furnishings, appliances, landscaping, artwork and any custom upgrades made to the property or building, and may not be accurate.
e.    MSWA’s settlement agents will undertake the conveyancing on behalf of MSWA and all settlements/conveyancing/transfer costs will be paid by MSWA. 
f.    Every endeavour will be made to transfer the Early Bird apartment to the winner as soon as possible. The conveyancing process is dependent on information supplied by a number of government departments and public utilities. Settlement is generally completed within 3 months of the Early Bird prize being drawn and with the Early Bird winner's 100-point ID check being completed and verified.
g.    Prize must be accepted, as awarded, with no cash equivalents available.
h.    If all tickets are sold before 11:59 PM (AWST) Thursday, 10 September 2026, then all prize draws will be completed on Tuesday, 15 September 2026 and published on mswalottery.com.au within 48 hours.  If tickets remain after the Early Bird Prize Sales Close, only the Early Bird Prize Draw will be completed on Tuesday, 15 September 2026 and published on mswalottery.com.au within 48 hours.

 
 

55. International Travel Experience Prizes
a.    Holiday prizes must be accepted as awarded, and do not include travel insurance, spending money or any other expenses unless otherwise stated.
b.    Holiday winners are required to book with Flight Centre and take their trip within 12 months of the relevant prize draws. 
c.    If the winner wishes to negotiate an arrangement with Flight Centre, this negotiation will be solely between the winner and Flight Centre. MSWA will not enter this process.
d.    To claim the prize, the winner will be required to complete a 100-point identification check and present their official winning ticket.

e.    One (1) Fiji Holiday for two (2) people including flights and accommodation
i.    Return economy flights from Perth to Fiji with Fiji Airways.
ii.    Five (5) nights accommodation at Crowne Plaza Fiji Nadi Bay Resort & Spa by IHG.
iii.    Included experiences are Best of Nadi Highlights, Sunset Dinner Cruise including Lobster and Island & Reef Day Sail.
iv.    This package is valued at AUD $10,000 at the time of quote.

i.    The vouchers are valued at AUD $200 each.

 

58. Entertainment Prizes
a.    Prizes must be accepted as awarded, with no cash equivalents available.
b.    All prizes will be posted to winners by Retravision within 30 days of the final prize draw.
c.    It is a condition of entry that all supporters ensure their postal address is up to date when purchasing a ticket as address changes cannot be completed following the prize draws. Changes to participants’ addresses may be made prior to the draw by contacting MSWA on 1300 769 019 or [email protected].
d.    Tracking details are not available for prizes that are posted and MSWA will not be liable for any lost or damaged packages.

 

59. State Buildings E-Gift Cards
a.    MSWA will present all winners with an e-gift card from State Buildings delivered to their nominated email address (or letter to their nominated address if an email address was not provided).
b.    Prizes must be accepted, as awarded, with no cash equivalents available.
