TERMS & CONDITIONS

Entry:

1. These Terms and Conditions, as published on the website www.mswalottery.com.au and as amended from time to time (“Terms”) govern the terms of your participation in the MSWA Mega Home Lottery (“Lottery”) operated by MSWA (ABN 75 638 080 972).

3. By purchasing a ticket in this lottery, you will be deemed to have read and agreed to be bound by these Terms.

4. The following people (and anyone who resides at the same address as them) are prohibited from purchasing a ticket:

  1. MSWA Board Members
  2. MSWA Executive Team Members
  3. MSWA Head of Departments
  4. MSWA Marketing Team Members
  5. MSWA Information Systems Team and Ticket Fulfilment Staff
  6. RSM Australia Directors and employees associated with the lottery draw
  7. Any staff member who works on the MSWA Account from MSWA’s associated agencies.

5. Participants must be 18 years or older.

6. The MSWA Mega Home Lottery is run primarily, but not exclusive to Western Australians. Winners who reside outside of Western Australia are responsible for any additional costs that may be associated with the delivery or transfer of prizes. If the winner resides in Victoria, gold bullion will be awarded in lieu of cash. Additionally, non-residents should consider the legislative requirements to owning land in Australia, should they win a property prize.

7. To claim prizes, ticket purchasers may be asked to provide proof of an Australian address. To claim a prize including cash (or a cash alternative), ticket purchasers must be able to provide proof of an Australian address and an Australian bank account.

8. Name changes on tickets are not permitted.

9. The records held by MSWA shall be deemed correct and final.

10. MSWA reserves the right to refuse sale or refund tickets to an individual at their discretion.

11. Where it is lawful to do so, these Terms may be updated and re-published online at www.mswalottery.com.au.

Tickets:

12. Lottery tickets are $100 each.

13. Only 205,000 tickets will be sold.

14. Assuming all 205,000 tickets are sold, each ticket has a 1 in 19 chance of winning a prize.

15. The names of all major prize winners will be available online within 48 hours of the prize draw at https://mswalottery.com.au.

16. The total retail value of prizes is $7,489,769.00 as at the time of MSWA’s purchase of said quote.

17. All prize winners will be notified in writing.

18. A complete list of all winners will be published on mswalottery.com.au within 48 hours after all remaining prize draws have been completed on Monday, 21 October 2024.

19. Promotional images of the prizes are for display purposes only. Prizes awarded may not be exactly as illustrated.

20. Prizes must be accepted as awarded.

21. Winners are responsible for claiming their prize and participants are required to ensure their postal address is up to date in the event that they are to win a prize and their prize is posted.

22. All participants must ensure their postal address is up to date when purchasing a ticket as address changes may not be accommodated following the prize draws.

23. The majority of prizes are supplied by Western Australian providers. Prize winners may be required to provide an address in the Perth metropolitan area for local delivery or make alternative arrangements to collect the prizes.

24. The winner(s) will be determined by a computerised random number generator which has been approved by the Department of Racing, Gaming and Liquor.

25. MSWA’s auditors, RSM Australia, will attend all prize draws to ensure completeness and fairness of the draws.

26. MSWA are not authorised to process ticket refunds without written approval from the Department of Racing, Gaming and Liquor. This process may take a number of weeks. Refunds cannot be offered after the final prize draws have begun.

Publicity and privacy policy:

27. Prize winners agree to have their name and suburb published by MSWA for publicity purposes.

28. By entering the Lottery, the prize winners consent to videos, audio recordings and photographs of the prize winners being used for reasonable promotional activities both in print and on the internet including on social media platforms.

29. By purchasing a ticket, participants agree to receive promotional materials for MSWA Lotteries & Raffles.

30. MSWA will not disclose any confidential information to any person other than in accordance with the MSWA Mega Home Lottery privacy policy. For information on the MSWA Mega Home Lottery privacy policy, visit mswalottery.com.au/privacy-policy or for a printed copy, call 1300 769 019.

Liability:

31. MSWA and associated agencies accept no responsibility for any loss, damage, accident, death or injury resulting from the promotion, and all contestants release from, and indemnify MSWA against any claim they may have in respect of all liability, cost, loss or expense arising out of acceptance of any prize or participation in the competition including (but not limited to) loss of income, personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

Prizes

32. Grand Prize:

a. The Grand Prize winner will win the fully furnished Claremont Home at 3 Lakeway St, Claremont 6010 valued at $3.5 million.

b. In addition, the winner will receive a $250,000 bank deposit or bank cheque made out to the ticket holder(s).

c. To claim the prize, the winner will be required to complete a 100-point identification check and present their official winning ticket.

d. The $250,000 bank deposit or bank cheque will be received within a maximum of 20 business days after the 100-point identification check has been completed and verified.

e. All tickets purchased before Midnight, Thursday, 17 October 2024 are eligible to win the Grand Prize.

f. The published estimated value of the Grand Prize is calculated based on the cost to MSWA for the land, build, furnishings, appliances, landscaping, artwork and any custom upgrades made to the property or building, and may not be accurate.

g. MSWAs settlement agents will undertake the conveyancing on behalf of MSWA and all settlements/conveyancing/transfer costs will be paid by MSWA.

h. Every endeavour will be made to transfer the Grand Prize Home to the winner as soon as possible. The conveyancing process is dependent on information supplied by a number of government departments and public utilities. Settlement is generally completed within 3 months of the Grand Prize winner's 100-point ID check being completed and verified.

i. Prize must be accepted, as awarded, with no cash equivalents available.

33. Early Bird Prize:

a. The Early Bird Prize winner will win a fully furnished apartment located at 2907/99 Mill Point Road, South Perth 6151 valued at $1.6 million.

b. To claim the prize, the winner will be required to complete a 100-point identification check and present their official winning ticket.

c. Only tickets purchased before Midnight, Thursday 12 September 2024 are eligible to win the Early Bird Prize.

d. If all tickets are sold before Midnight, Thursday 12 September 2024, then all prize draws will be completed on Monday, 16 September 2024 and published on mswalottery.com.au within 48 hours.

e. If tickets remain after the Early Bird Sales Close, only the Early Bird Prize Draw will be completed on Monday, 16 September 2024 and published on mswalottery.com.au within 24 hours.

f. The Early Bird Prize winning ticket is also eligible for the Mega Cash Prize Draw and Final Grand Prize Draws.

g. The published estimated value of the Early Bird Prize is calculated based on the cost to MSWA for the apartment, furnishings, appliances, landscaping, artwork and any custom upgrades made to the property or building, and may not be accurate.

h. MSWAs settlement agents will undertake the conveyancing on behalf of MSWA and all settlements/conveyancing/transfer costs will be paid by MSWA.

i. Every endeavour will be made to transfer the Grand Prize Home to the winner as soon as possible. The conveyancing process is dependent on information supplied by a number of government departments and public utilities. Settlement is generally completed within 3 months of the Early Bird winner's 100-point ID check being completed and verified.

34. Mega Cash Prize:

a. The Mega Cash Prize winner will win $500,000 bank deposit or bank cheque made out to the ticket holder(s).

b. To claim the prize, the winner will be required to complete a 100-point identification check and present their official winning ticket.

c. The bank deposit or bank cheque will be received within a maximum of 20 business days after the 100-point identification check has been completed and verified.

d. If all tickets are sold before Midnight, Thursday, 26 September, then all prize draws will be completed on Monday, 30 September 2024 and published on mswalottery.com.au within 48 hours.

e. If tickets remain after the Mega Cash Prize Sales Close, only the Mega Cash Prize Draw will be completed on Monday, 30 September 2024 and published on mswalottery.com.au within 24 hours.

f. The Mega Cash Prize winning ticket is also eligible for the Final Grand Prize Draws.

35. Holiday Prizes:

a. Holiday prizes must be accepted as awarded, and do not include travel insurance, spending money, an Australian passport or any other expenses unless otherwise stated.

b. Holiday winners are required to book and take their trip within 12 months of the prize draws.

c. If the winner wishes to negotiate an arrangement with Flight Centre, this negotiation will be solely between the winner and Flight Centre. MSWA will not enter this process. Flight Centre terms and conditions at help.flightcentre.com.au/s/article/booking-terms-conditions-au

d. To claim the prize, the winner will be required to complete a 100-point identification check and present their official winning ticket.

e. If the winner wishes to negotiate an arrangement with Flight Centre, this negotiation will be solely between the winner and Flight Centre. MSWA will not enter this process.

f. Fiji Holiday for 2 Adults

i. The package includes 7 nights’ accommodation at Radisson Blu Resort.

ii. Flights are with QANTAS airways.

iii. Travel is booked for 11 Sep 2025 - 18 Sep 2025 and can be changed for a fee, based on availability. MSWA is not liable to pay for any fees to change these travel dates.

iv. This prize package is valued at $10,000 at the time of quote.

v. Flights will be departing from and returning to Perth.

g. Norway Holiday for 2 Adults

i. The package includes 7 nights’ accommodation at the Grand Hotel – Grand Petite Room.

ii. Flights are with Emirates airways.

iii. Travel is booked for 9 Mar 2025 – 18 Mar 2025 and can be changed for a fee, based on availability. MSWA is not liable to pay for any fees to change these travel dates.

iv. This prize package is valued at $10,000 at the time of quote.

v. Flights will be departing from and returning to Perth.

h. Broome Holiday for 2 Adults

i. The package includes 7 nights’ accommodation at Oaks Cable Beach Resort.

ii. Flights are with Virgin Australia.

iii. Travel is booked for 13 Jun 2025 - 20 Jun 2025 and can be changed for a fee, based on availability. MSWA is not liable to pay for any fees to change these travel dates.

iv. This prize package is valued at $3,000 at the time of quote.

v. Flights will be departing from and returning to Perth.

36. Entertainment Prizes:

a. Prizes must be accepted as awarded, with no cash equivalents available.

b. All prizes will be posted to winners by Retravision within 30 days of the final prize draw.

c. It is a condition of entry that all supporters ensure their postal address is up to date when purchasing a ticket as address changes cannot be completed following the prize draws. For any changes. Changes to participants’ addresses may be made prior to the draw by contacting MSWA on 1300 769 019 or [email protected]

d. Tracking details are not available for prizes that are posted and MSWA will not be liable for any lost or damaged packages.

37. State Buildings E-Gift Cards:

a. MSWA will present all winners with an e-gift card from the State Buildings delivered to their nominated email address (or letter to their nominated address if an email address was not provided).  

b. Prizes must be accepted, as awarded, with no cash equivalents available.

c. Winners will have 3 years to use their e-gift card from the date of issue.

44. For ACT residents, the following terms and conditions apply:

a. The winner(s) will be determined by a computerized random number generator.

b. All prize winners will be notified in writing within 21 days of the final prize draw, conducted on Monday, 21 October 2024.

c. A complete list of all winners will be published on mswalottery.com.au within 48 hours after all remaining prize draws have been completed on Monday, 21 October 2024.

d. The final draws will be conducted at MSWA at 154 Abernethy Road, Belmont WA 6104.

e. Winners will have 12 months to claim prizes, if prizes are unclaimed after MSWA has made reasonable attempts to contact the winner, MSWA has the right to redraw these prizes. If a redraw is required then it will be conducted on Tuesday, 21 October 2025 at 10:00am WST.

MSWA Mega Home Lottery 24B

MSWA Wildcats Courtside Seats Trade Promotion - Terms and Conditions

1. The name of this promotion is the “MHL24B MSWA Wildcats Courtside Seats – October 25”.

2. The promoter is MSWA Limited ACN: 670 532 224 of 154 Abernethy Road Belmont WA 6104

3. These terms and conditions, as published on the website www.mswalottery.com.au and as amended from time to time (“Terms”) govern the terms of your participation in the MHL24B MSWA Wildcats Courtside Seats – October 25 promotion.

4. By participating in this promotion entrants agree to be bound by these Terms.

5. MSWA reserves the right to refuse sale or refund tickets to an individual at their discretion.

6. The prize on offer is a package of 2 x courtside tickets for the Perth Wildcats basketball game on Friday, 25 October 2024 at RAC Arena (valued at $1,143).

7. Entry is open to people over the age of 18.

8. Entry can be made via this method:

a) Register their interest via the online form.

b) Hold at least one ticket in the current Lottery (MSWA Mega Home Lottery 24B) at the time of the draw close at midnight, Thursday, 17 October 2024.

c) The participant will receive an entry for each MSWA Mega Home Lottery 24B ticket that they hold at the time of the draw close. i.e. For a participant who holds one ticket, they will receive one entry. For a participant who holds two tickets, they will receive two entries, and so on.

9. The email address used to register interest via the online form must match the email address used to purchase the eligible Mega Home Lottery 24B ticket. If the email provided cannot be matched with an eligible Mega Home Lottery 24B ticket, then the entrant will be removed from the draw.

10. Each individual entry will have equal odds of winning the prize.

11. Entries into the draw will be accepted from Thursday, 3 October 2024 until the promotion closes at midnight, Thursday, 17 October 2024.

12. For the purpose of the prize draw, all valid entries will be entered into a computerised database.

13. The prize will be drawn on Thursday, 24 October 2024.

14. The winner of this promotion will be determined by a computerised random number generator.

15. The winner may be required to complete a 100-point identification check to claim the prize.

16. If the prize winner cannot be contacted within 12-hours of the draw, after reasonable efforts have been made by MSWA to contact them, then MSWA reserves the right to redraw the prize.

17. Tickets will be shared digitally, via email.

18. The prize must be taken as supplied and it is not transferable. No responsibility is accepted for any variation in the value of the prize.

19. Prize winners agree to have their name, suburb and images published by MSWA for publicity purposes.
